§1. Allgemeines
Citytixx.com GmbH is not the organizer of any offers on the Citytixx.com homepage, Citytixx.com GmbH acts as an intermediary. The events are carried out by the respective organizer. The organizer is solely responsible for the services purchased by the customer. It is possible that the organizer may apply its own general terms and conditions. By booking services with Citytixx.com, Citytixx.com GmbH is exclusively commissioned to purchase and dispatch tickets.
§2 Scope of application
These General Terms and Conditions (GTC) shall apply:
a.) For the commissioning of the purchase and dispatch of tickets for events listed on the Citytixx.com homepage.
b.) For contracts and orders relating to the arrangement of travel.
c.) These GTC apply to both entrepreneurs and consumers within the meaning of Section 1 (2) KSchG.
The company’s deliveries, services and offers are made exclusively on the basis of these terms and conditions; Citytixx.com does not recognize any terms and conditions of the customer that conflict with or deviate from these terms and conditions, unless the company has expressly agreed to their validity. In this respect, acts of contract fulfillment on the part of Citytixx.com do not constitute consent to contractual conditions that deviate from these terms and conditions. These terms and conditions also apply as a framework agreement for all further legal transactions between the contractual partners.
§3 Conclusion of contract
When the customer clicks on the “Buy” button, a contract offer is made. A valid contract is only concluded when Citytixx.com GmbH sends the order confirmation. This contract is concluded between the customer and the organizer of the respective booked event. As explained above, Citytixx.com GmbH only acts as an intermediary.
§4 Prices
Unless expressly stated otherwise, all prices quoted are inclusive of value added tax (VAT). Should wage costs change due to collective bargaining agreements in the industry or internal company agreements or should other cost centers relevant for the calculation or costs necessary for the provision of services change, Citytixx.com is entitled to increase or reduce the prices accordingly.
§5 Terms of payment, interest on arrears
If no agreement to the contrary has been made, the claims of Citytixx.com GmbH are to be paid concurrently. Cash discount deductions require a separate agreement. In the event of default in payment, including partial payments, any discount agreements shall also cease to apply. Payments by the customer are only deemed to have been made at the time of receipt in the Citytixx.com GmbH business account. If the customer is in default of payment, Citytixx.com is entitled, at Citytixx.com’s discretion, to demand compensation for the damage actually incurred or default interest at the statutory rate. Citytixx.com is also entitled to demand compound interest from the date of delivery of the goods in the event of default of payment by the customer.
§6 Cancellations, withdrawal, revocation
a.) Für Dienstleistungen, die im Zusammenhang mit Freizeitbetätigungen erbracht werden, (Beherbergung, sofern kein Wohnzweck, Beförderung von Waren, Vermietung von Kraftfahrzeugen oder die Lieferung von Speisen und Getränken) sofern jeweils für die Vertragserfüllung durch Citytixx.com ein bestimmter Zeitpunkt oder Zeitraum vertraglich vorgesehen ist, besteht kein Rücktrittsrecht gemäß § 18 Abs. 1 Z 10 FAGG.
a.) For services that are provided in connection with leisure activities (accommodation, if not for residential purposes, transportation of goods, rental of motor vehicles or the delivery of food and beverages), provided that a specific time or period is contractually stipulated for the fulfillment of the contract by Citytixx.com, there is no right of withdrawal in accordance with § 18 para. 1 no. 10 FAGG.
c.) For goods that do not fall within the above-mentioned area (value vouchers, CDs, fan articles, etc.), the statutory regulation according to FAGG applies. To assert the right of withdrawal, send a clear declaration by post, fax or e-mail to Citytixx.com GmbH. This declaration should contain your clear intention. Please note the statutory period of fourteen days.

Die Kosten für den Rückversand wird durch den Kunden übernommen. Nach dem Einsenden der Erklärung wird die Ware auf ihre Beschaffenheit, Eigenschaften und Funktionsweise geprüft. Sofern sie einwandfrei ist, wird dem Kunden die Zahlung erstattet. Diese Rückzahlung erfolgt an dasselbe Zahlungsmittel, das der Verbraucher bei der ursprünglichen Transaktion eingesetzt hat.

§7. Besetzungs-, Termin- und/oder Programmänderungen und Verschiebungen sowie Veranstaltungsabsagen
a.) Citytixx.com GmbH only arranges tickets between customers and event organizers and is therefore not responsible for the reimbursement of admission fees in the event of cancellations, changes or postponements of events. Citytixx.com GmbH accepts no liability whatsoever for travel, hotel or similar costs incurred in connection with canceled/postponed/relocated events.
b.) Tickets may not be returned or exchanged in the event of changes to the cast, the date or time of the event or the program, even if these changes are made at short notice. Changes to the cast are under no circumstances a reason for the return of tickets, as this is not considered to be the basis for the purchase of tickets. The organizers expressly reserve the right to make changes to the cast. In the event of cancellation or a change to an event, the customer can only request a refund of the ticket price directly from the organizer, but not from Citytixx.com GmbH.
c.) Citytixx.com GmbH is not obliged to inform ticket holders of any cancellations/postponements/relocations, but will endeavor to do so as far as possible (this is a voluntary additional service provided by Citytixx.com GmbH).
d.) If Citytixx.com charges the customer a booking fee (system fee and service fee) or shipping expenses, but the event is canceled, these fees or expenses cannot be refunded to the customer under any circumstances, as the service of the agency has already been provided by Citytixx.com GmbH.
§8. Haftungsausschluss
a.) If, for technical, organizational or other reasons, it is not possible to obtain the tickets booked or pre-reserved and already paid for by a customer, Citytixx.com GmbH will refund the ticket price including any fees and expenses without any deductions. Citytixx.com GmbH accepts no liability whatsoever for expenses directly or indirectly related to the booking (which has become invalid) (e.g. reimbursement of travel cancellation costs).
b.) Citytixx.com GmbH shall only be liable for damages resulting from culpable breach of contract in the event of its own fault or that of a vicarious agent in cases of intent or gross negligence. Liability for culpable injury to life, limb or health remains unaffected; this also applies to mandatory liability under the Product Liability Act. The existence of slight or gross negligence must be proven by the injured party, unless it is a consumer transaction.
In all other respects, the statutory warranty provisions shall apply. The assignment of these claims by the customer is excluded.
c.) Neither the organizer nor the points of sale can assume any guarantee for the correctness and completeness of the event data posted on Citytixx.com GmbH due to the possibility of the ticket sales system being influenced by transmission errors, technical faults or unlawful interventions by third parties. The ticket purchaser has the right to withdraw from the contract if the ticket order was placed on the basis of event data that was demonstrably incorrect on Citytixx.com GmbH and therefore data that is demonstrably relevant for the ticket purchase (date, prices, locations) must be subsequently changed by Citytixx.com GmbH or by the organizer. Processing fees paid in addition to the ticket price will not be refunded.
d.) Citytixx.com GmbH accepts no liability for the actions, omissions or other conduct of event organizers, other customers, advertising partners and/or sponsors in connection with the services of Citytixx.com GmbH or with the use of the Citytixx.com website.
e.) Access to and use of the website, as well as any information contained or referred to therein, is the sole responsibility of the user. References to other Internet pages are characteristic elements of the WWW, but the contents of linked pages are not part of this website. Eine Gewährleistung oder Haftung für Inhalte und inhaltliche Änderungen auf verwiesenen Seiten ist ausdrücklich ausgeschlossen.
§9 Image recordings
During the visit to the event, any audio and/or video recordings by the event visitor are prohibited unless the organizer has given its prior consent to such recordings.
§10. Copyright
Citytixx.com GmbH is the owner of all rights to the images and content on the Citytixx.com homepage. These images or the content can only be used by written agreement.
§11. Datenschutz
Der Umgang mit persönlichen Daten ist in der Datenschutzerklärung geregelt. Diese ist jederzeit auf www.citytixx.com abrufbar.
§12. Sonstige Bestimmungen
a.) Änderungen, Zusätze
Jede Änderung oder jeder Zusatz zu diesem Vertrag benötigt die Schriftform und muss von beiden Parteien unterzeichnet werden. Mündliche Nebenabreden zwischen den Vertragsparteien sind nichtig.
b.) Vorvertraglich getroffenen Vereinbarung
Ab dem Zeitpunkt des Abschlusses des Vertrages werden jegliche Vereinbarungen, die früher getroffen wurden, gegenstandslos. Das bedeutet, dieser Vertrag wird ohne Zusatzvereinbarungen abgeschlossen.
c.) Salvatorische Klausel
Sollten Punkte des Vertrages aufgrund des zwingenden Rechts unwirksam sein, so berührt das nicht die Wirksamkeit der anderen Punkte. Jeder unwirksame Punkt wird aufgehoben, stattdessen tritt geltendes Recht ein.
§13. Anzuwendendes Recht und Gerichtsstand
Auf diesen Vertrag ist ausschließlich österreichisches Recht unter Ausschluss der Kollisionsnormen und des UN Kaufrechtes anzuwenden. Für alle Rechtstreitigkeiten aus oder im Zusammenhang mit diesem Vertrag ist ausschließlich jenes Gericht sachlich zuständig, in dessen Sprengel die Citytixx.com GmbH ihren Sitz hat.
Affiliate Terms of Use
As an authorized affiliate (Affiliate) of CityTixx GmbH, you agree to abide by the terms and conditions contained in this Agreement (Agreement). Please read the entire Agreement carefully before registering and promoting CityTixx GmbH as an Affiliate.
Your participation in the Program is solely to legally advertise our website to receive a commission on memberships and products purchased by individuals referred to CityTixx Konzerte (CityTixx GmbH) by your own website or personal referrals.
By signing up for the CityTixx Konzerte Affiliate Program (CityTixx GmbH), you indicate your acceptance of this Agreement and its terms and conditions.
Approval or Rejection of the Application
We reserve the right to approve or reject ANY Affiliate Program Application at our sole and absolute discretion. You will have no legal recourse against us for the rejection of your Affiliate Program Application.
Commissions
Commissions will be paid once a month. For an Affiliate to receive a commission, the referred account must remain active for a minimum of 31 days.
You cannot refer yourself, and you will not receive a commission on your own accounts.
Payments will only be sent for transactions that have been successfully completed. Transactions that result in chargebacks or refunds will not be paid out.
Termination
Your affiliate application and status in the Program may be suspended or terminated for any of the following reasons:
- Inappropriate advertisements (false claims, misleading hyperlinks, etc.).
- Spamming (mass email, mass newsgroup posting, etc.).
- Advertising on sites containing or promoting illegal activities.
- Failure to disclose the affiliate relationship for any promotion that qualifies as an endorsement under existing Federal Trade Commission guidelines and regulations, or any applicable state laws.
- Violation of intellectual property rights. CityTixx GmbH reserves the right to require license agreements from those who employ trademarks of CityTixx Konzerte in order to protect our intellectual property rights.
- Offering rebates, coupons, or other form of promised kick-backs from your affiliate commission as an incentive. Adding bonuses or bundling other products with CityTixx GmbH, however, is acceptable.
- Self referrals, fraudulent transactions, suspected Affiliate fraud.
In addition to the foregoing, CityTixx Konzerte reserves the right to terminate any Affiliate account at any time, for any violations of this Agreement or no reason.
Affiliate Links
You may use graphic and text links both on your website and within in your email messages. You may also advertise the CityTixx GmbH site in online and offline classified ads, magazines, and newspapers.
You may use the graphics and text provided by us, or you may create your own as long as they are deemed appropriate according to the conditions and not in violation as outlined in the Termination section.
Coupon and Deal Sites
CityTixx GmbH occasionally offers coupon to select affiliates and to our newsletter subscribers. If you’re not pre-approved / assigned a branded coupon, then you’re not allowed to promote the coupon. Below are the terms that apply for any affiliate who is considering the promotion of our products in relation to a deal or coupon:
- Affiliates may not use misleading text on affiliate links, buttons or images to imply that anything besides currently authorized deals to the specific affiliate.
- Affiliates may not bid on CityTixx Coupons, CityTixx Discounts or other phrases implying coupons are available.
- Affiliates may not generate pop-ups, pop-unders, iframes, frames, or any other seen or unseen actions that set affiliate cookies unless the user has expressed a clear and explicit interest in activating a specific savings by clicking on a clearly marked link, button or image for that particular coupon or deal. Your link must send the visitor to the merchant site.
- User must be able to see coupon/deal/savings information and details before an affiliate cookie is set (i.e. “click here to see coupons and open a window to merchant site” is NOT allowed).
- Affiliate sites may not have “Click for (or to see) Deal/Coupon” or any variation, when there are no coupons or deals available, and the click opens the merchant site or sets a cookie. Affiliates with such text on the merchant landing page will be removed from the program immediately.
Pay Per Click (PPC) Policy
PPC bidding is NOT allowed without prior written permission.
Liability
CityTixx will not be liable for indirect or accidental damages (loss of revenue, commissions) due to affiliate tracking failures, loss of database files, or any results of intents of harm to the Program and/or to our website(s).
We do not make any expressed or implied warranties with respect to the Program and/or the memberships or products sold by CityTixx. We make no claim that the operation of the Program and/or our website(s) will be error-free and we will not be liable for any interruptions or errors.
Term of the Agreement
The term of this Agreement begins upon your acceptance in the Program and will end when your Affiliate account is terminated.
The terms and conditions of this agreement may be modified by us at any time. If any modification to the terms and conditions of this Agreement are unacceptable to you, your only choice is to terminate your Affiliate account. Your continuing participation in the Program will constitute your acceptance of any change.
Indemnification
Affiliate shall indemnify and hold harmless CityTixx GmbH and its affiliate and subsidiary companies, officers, directors, employees, licensees, successors and assigns, including those licensed or authorized by CityTixx GmbH to transmit and distribute materials, from any and all liabilities, damages, fines, judgments, claims, costs, losses, and expenses (including reasonable legal fees and costs) arising out of or related to any and all claims sustained in connection with this Agreement due to the negligence, misrepresentation, failure to disclose, or intentional misconduct of Affiliate.
Electronic Signatures Effective
The Agreement is an electronic contract that sets out the legally binding terms of your participation in the CityTixx GmbH affiliate program. You indicate your acceptance of this Agreement and all of the terms and conditions contained or referenced in this Agreement by completing the CityTixx GmbH application process. This action creates an electronic signature that has the same legal force and effect as a handwritten signature.
